(2) Ifany educational institution referred to in subsection (1) fails or refuses to furnish the particulars requested by the Council in terms of that subsection; or it appears to the Council that any provision of this Act or any condition prescribed or determined by or in terms of this Act pertaining to the educational institution referred to in subsection (1) is not properly being complied with, and that such improper compliance may adversely affect the standard of the education, tuition and training in respect of the professional training concerned to be maintained at such educational institution, the Minister may determine, on the recommendation of the Council and by notice in the Gazette, that any qualification granted by the educational institution after the date, specified in such notice does not entitle any holder thereof to registration in terms of this Act. (3) The Minister may determine, on the recommendation of the Council and by notice in the Gazette, whether or not any qualification other than a qualification referred to in subsection (2), and granted subsequent to the date specified in such notice by the educational institution referred to in that subsection, entitles the holder thereof to registration in terms of this Act. (4) The Minister may repeal or amend, on the recommendation of the Council, any notice published in terms of subsection (2) or (3), if it appears to the Minister that the educational institution in respect of which such notice was published has made satisfactory provision to comply with the requirements of this Act or with the prescribed or other conditions referred to in subsection (2) (b). (5) A qualification specified in a notice issued in terms of subsection (2) which had been granted by an educational institution to which the notice relates between the date specified in such notice and the date of the repeal of such notice, does not entitle the holder thereof to registration in terms of this Act. (6) The Council may appoint in writing, for the purposes of subsection (2) (b), a person to investigate, subject to section 51, whether the prescribed conditions, and the conditions and requirements determined by the Council, in respect of an educational institution referred to in that subsection are being complied with by such educational institution, and to report to the Council on such investigation within such period of time and in such manner as the Council may determine and specify in such written appointment.
